Customer Undertaking: Terms & Conditions governing the ride

This Undertaking establishes a binding agreement between You (Herein referred to as the Customer/Pillion) and  Bikers Essential Private Limited with Brand Name “Royal Bikers” (Herein referred to as the Company)  with regards to the use of various services that are offered by Royal Bikers / Bikers Essential Private Limited.

The Customer agrees and undertakes that:

  1. The Customer & pillion (if any) is a major and is not a person barred from availing the Services of the Company under the laws of India or other applicable laws.
  2. By availing the Services provided by the Company, the Customer constitutes an acknowledgement and acceptance of this Agreement. If the Customer does not agree with any terms, conditions and notices, the Customer must not avail any of the services provided by the Company.
  3. The Company reserves the right to change the terms, conditions and notices contained/omitted in this Agreement from time to time, without any prior notice.
  4. In case the customer is carrying a pillion, he/she shall be fully responsible for the acts, errors, omissions, delays, accidents, losses, injuries, deaths, property damage, or any indirect or consequential damages resulting therefrom, while availing the services of the Company.
  5. The customer shall provide the following mandatory documents, in addition to any other document as asked by the Company to make necessary bookings for the Customer
  6. A) A copy of valid passport with an expiry date at least 6 months beyond the completion of the tour.
  7. B) A copy of Visa.
  8. C) A copy of valid Motorcycle Driving License along with an attested copy of translated copy in English by designated officials.
  9. D) A copy of valid international driving permit, with an attested copy of translated copy in English by designated officials ( if necessary).
  10. E) A copy of valid insurance policy covering health, belongings, luggage, repatriation etc.

In case of absence of any of the above documents, the customer shall not be allowed to participate in the tour / trip by the Company.

  1. The customer & pillion (if any) is medically fit to travel for the term as stated in the itinerary of the tour and has taken the necessary medical precautions by consulting professional medical practitioners and is well aware that travelling on an altitude of more than 12,000 feet above sea level for consecutive days involves additional risks which require good physical & mental fitness with adequate stamina. The customer also undertakes that he/she & pillion (if any) is medically fit to travel at an altitude of more than 19,000 feet above sea level; which might be included in the tour / trip as per the itinerary.
  2. In case, the Customer & pillion (if any) is suffering from any diseases including but not limited to asthma, breathing ailments, food allergies , any allergies etc., the customer is carrying the required medicines / medical documentation required for his / her safety, has sought medical advice to participate in this trip and indemnifies the Company of any liabilities in case of any injury / death of the customer(s) / pillion(s) / any other person as a result of availing the services of the Company.
  3. The Customer is required to have an adequate riding experience including on-road as well as off-road experience on large capacity / heavy motorcycles as the tour strictly requires the customer to ride with sufficient skill, extra care and confidence.
  4. Checking the motorcycle before hitting ignition or/and riding is the sole responsibility of the customer. In case there is any malfunction found or any repair required, the customer has to immediately inform and notify the representatives of the Company so the necessary steps could be taken at the earliest.
  5. In case, the Customer & pillion (if any) is committing negligence including but not limited to speeding the motorcycle, ignoring safety guidelines, not obeying the rules/guidelines administered by the Company, inconsiderate towards the applicable laws or the traffic rules, driving under the influence of alcohol or any judgement impairing drug or indulging in substance abuse etc., will face instant termination of the tour / journey followed by completing the remaining part of the trip/tour in the support vehicle. In such case, no refund / reimbursement shall be provided to the customer(s).
  6. Consumption of alcohol and the use of any Narcotic drugs and psychotropic substances including but not limited to cannabis, cocaine, marijuana & such are strictly prohibited before and during the tour / trip as such substances is detrimental to senses/ reflexes /oxygen absorption and levels at high altitudes, which can compromise safety and performance. The customer undertakes that adherence to these regulations is mandatory to ensure the well-being and safety of all participants.
  7. The Company tries to ensure that all the information provided by the company is correct, but the Company neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information. the Company makes no warranty, express or implied, concerning the services provided to the customers and disclaims all warranties of fitness for a specific purpose and warranties of merchantability in respect of services including any liability, responsibility or any other claim, whatsoever, in respect of any loss, whether direct or consequential to any Customer or any other person, arising out of or from the use of any such services / information.
  8. In cases of additional services / extra assistance required by the customer; the company acts as a booking agent on behalf of third party service providers, it shall not have any liability whatsoever for any aspect of the arrangements between the third party and the Customer.
  9. The Customer accepts the unique, adventurous / challenging / difficult / risky nature of the tour/trip. The customer shall be solely liable / responsible for any direct, indirect, punitive, incidental, special, consequential damages, personal injury or property damage or loss suffered during the course of tour/trip under this Agreement, whether arising out of breach of warranty, breach of condition, breach of contract, tort, civil liability or otherwise.
  10. The Company is committed to provide hygienic cuisine as a part of their services. However, given the aforesaid nature of the tour/trip it might be possible that during certain segments of the tour/trip, particularly in remote or off-the-beaten-path locations, meals / dinner would be provided at local establishments. While these meals offer an authentic and culturally enriching experience, they might not always adhere to international hygiene standards. The customer acknowledges and accepts the unique adventurous / challenging / difficult / risky nature of the tour/trip including but not limited to food allergies, food poisoning and such. The customer shall be solely liable / responsible for any personal injury or property damage or loss suffered during the course of tour/trip under this Agreement.
  11. If the customer needs any special dietary requirements, such as a preference for vegetarian meals or has any food allergies, the customer must notify/inform the Company at least 45 days before the commencement of the trip/tour.
  12. The Customer shall conduct themselves in a respectable manner and respect the code of conduct throughout the duration of the tour / trip showing additional courtesy, politeness, safety, modesty & shall not cause annoyance, distress, discomfort while encountering the local residents, animals, flora and fauna etc. The customer also undertakes not to participate in racism to anybody including but not limited to the fellow customers, local residents etc.
  13. The maximum liability on part of the Company arising under any circumstances, in respect of any services availed, shall be limited up to a maximum of the refund of total amount received from the customer in Indian Rupees (irrespective of the Currency value of the day of reimbursement / cancellation/ dispute and such) for availing the services less any cancellation charges, refund charges or others charges, as may be applicable. In no case the liability shall include any consequential loss, damage or additional expense whatsoever.
  14. Under no circumstances shall the Company be held liable if customers are stopped/ not allowed from continuing the tour due to national security / any other concerns near border areas or any other areas included in the itinerary. In such instances, the Company will make every reasonable effort to accommodate the affected customers with necessary amenities. However, the Company’s liability is expressly disclaimed for any disruptions or inconveniences arising from these security-related interruptions.
  15. In case the following have a direct impact on the financial program, The Company reserves the right to make appropriate adjustments / modifications at it’s own discretion :
  16. A) if actual average ticket price varies from estimate [10 %];
  17. B) If a Force Majeure event occurs.
  18. C) If any unforeseen circumstance arises.
  19. The customer shall provide only true, accurate, correct and complete information to the representative(s)/agent(s)/employee(s) & such of the Company before/during the tour / trip. If the customer provides any information that is untrue, inaccurate, incorrect or incomplete or the Company has reasonable grounds to suspect the same, the Company reserves the right to suspend or terminate the Customer’s tour / trip and refuse any and all current or future use of their Service.
  20. A refundable safety deposit of USD 200 shall be required to be paid by the Customer  as a prerequisite for the assignment of a motorcycle to the customer. The Customer undertakes full responsibility for any damages sustained to the motorcycle or loss to the motorcycle as a result of the customer participating in the tour/trip. The customer also undertakes that should the damages exceed the amount of the aforesaid safety deposit, the Company reserves the right to claim the additional costs from the customer separately as well as forfeit the documents provided by the customer in case of deliberate default from the customer’s end. If no damages are incurred during the motorcycle expedition, the full cash deposit will be returned to the customer as per the Dollar/Rupee Conversion rate of the day of deposit of motorcycle safety deposit. In the event of minor damages, the cost of repairs will be deducted from the aforesaid deposit paid by the customer, and the remaining balance will be refunded to the customer as per the terms of this agreement.
  21. Repairs for minor accidental damage upto 20 USD, including but not limited to motorcycles falling over or light spills and such, will be taken care by the Company.
  22. Under any circumstances, if at any stage of the tour / trip / itinerary, the customer(s) wish to terminate / cancel / the tour/ trip, the Company is not liable for any refund. Motorcycle security deposit of the customer shall stand forfeited along with extra costs to cover additional costs including but not limited to arranging logistics of the motorcycle etc.
  23. In case of cancellation / No Show by a customer after confirmation of the booking, a Cancellation fee / No show fee will be levied on the booking irrespective of the circumstances, in the following manner :
No. of days prior to the commencement of the tour Applicable Cancellation/ No show fee
> 45 days 10% of the total fee
31-45 days 25% of the total fee
16-30 days 50% of the total fee
0-15 days prior or No-show 100% of the total fee

The refund will be initiated within 20 working days from the receipt of cancellation request over email from the Customer provided all the required details for disbursal of the refund are provided over the email: info@royalbikers.com. No other mode of communicating a cancellation is valid.

  1. The Company reserves the right to alter/modify/change the itinerary of the tour/trip if any circumstance including but not limited to weather conditions, force majeure, road conditions & such might jeopardize the safety / health of the customers. In any such event, any decision by the Company shall be deemed final and no refund/ re-imbursement shall be provided to the customer.
  2. Under any circumstance, where the Company incurs significant incidental expenses in any manner due to revised scheduling, equipment / motorcycle / tools mishandling by customer(s), force majeure, customer negligence, loss of motorcycle and such; the customer will be required to bear all the costs on his own.
  3. If any provision of this Agreement is set/determined to be invalid or unenforceable in whole or partly, such invalidity or unenforceability shall attach only to such provision or a part of such provision and also the remaining part of such provision and all other provisions of this Agreement shall still be in full force and impact.
  4. This agreement shall be ruled in accordance with the laws of India. Any disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of New Delhi.
  5. The customer hereby authorizes the Company to contact the customer for their feedback on various services offered by the Company. Such feedback may be collected through emails, telephone calls, SMS or any other medium from time to time. In case the Customer chooses not to be contacted, such Customer shall write to the Company for specific exclusion at info@royalbikers.com.
